Seller Data Protection Addendum

Your duties when handling buyer personal data received through Link345.

Purpose and Scope

This addendum operationalises the “Data Protection and Privacy” section of our Terms and Conditions for anyone who sells on Link345 (individual sellers, business accounts, and storefront team members). It explains how you must handle the buyer personal data you receive through the platform — typically names, email addresses, phone numbers, and delivery addresses provided so you can fulfil a transaction.

This addendum is not a controller-to-processor data processing agreement. As set out in the Terms, you and Link345 (operated by Sands Ltd) each process personal data as separate and independent controllers. You are individually responsible for complying with the obligations that apply to you as a controller under applicable data protection laws, including the Cayman Islands Data Protection Act.

What You Receive and Why

Through Link345 you receive the information necessary to process transactions — in particular the contact and delivery details of the buyer involved in a transaction — as well as aggregated performance information about your listings. Buyer personal data is disclosed to you for one purpose only: fulfilling that transaction (confirming, packing, shipping or delivering the order, and handling returns, cancellations, or disputes connected to it).

Your Obligations

  • Purpose limitation: use buyer personal data exclusively for the transaction it was disclosed for. Do not use it for marketing, prospecting, enrichment, or profiling, and do not disclose or sell it to anyone else, unless the buyer has separately and explicitly consented or the law requires it.
  • Erasure after fulfilment: erase buyer personal data promptly once the transaction purpose has been fulfilled (including any return or dispute window). Further retention is only permitted where a legal obligation applies to you (e.g. invoicing or tax record-keeping).
  • Security: protect buyer personal data with appropriate safeguards. Do not post it publicly, share order screenshots containing buyer details, or store it in unsecured spreadsheets or group chats.
  • International transfers: if you transfer buyer personal data outside the Cayman Islands (e.g. to an overseas fulfilment partner), you are responsible for providing appropriate safeguards required by applicable data protection laws.
  • Data subject requests: if a buyer contacts you to exercise privacy rights over data you hold as a controller, you must handle that request yourself. You may direct platform-level requests to privacy@link345.ky.
  • Breach awareness: if buyer personal data you received through Link345 is lost, stolen, or improperly disclosed, notify us at privacy@link345.ky in addition to any notification duties you have under applicable law.

Consequences of Non-Compliance

Misusing buyer personal data is a breach of the Terms and Conditions and may result in disciplinary action up to and including account suspension, in addition to any liability you may have directly to the buyer or under applicable law.

Relationship to Other Documents

This addendum supplements, and should be read together with, the Terms and Conditions (Data Protection and Privacy) and our Privacy Notice. If this addendum conflicts with the Terms, the Terms prevail.
